GIVEAWAY RULES DATED 21/07/23
1. DEFINITIONS
1.1 Giveaway - a giveaway, i.e. a marketing campaign of an advertising nature conducted on the Instagram platform, on July 21, 2023.
1.2 Organizer - Ewa Woźniak, conducting business activity under the name EWA WOŹNIAK, at ul. Dyrekcyjna 3, 50-528 Wrocław, on the basis of an entry in the Central Register and Information on Business Activity, NIP number: 6932155187, REGON number: 385380808, and Michał Greń, conducting business activity under the name MICHAŁ GREŃ, at ul. Dyrekcyjna 3, 50-528 Wrocław, on the basis of an entry in the Central Register and Information on Business Activity, NIP number: 8943150645, REGON number: 385375167, acting jointly within a civil partnership under the name KOKOSEK BABY STORE sc, NIP 8992877117, REGON number 385561480.
1.3 Regulations - these regulations of the giveaway dated July 21, 2023.
1.4 Participant - a natural person with full legal capacity, with a residential address in the Republic of Poland, with an account on the Instagram platform and with the technical equipment necessary for the proper use of such an account.
2. GIVEAWAY RULES
2.1 The Giveaway runs from July 21, 2023, to July 31, 2023, subject to the Organizer's possible extension. The Organizer will announce any extensions to the Giveaway by posting an announcement on the KOKOSEK.PL Instagram profile.
2.2 In order for a Participant to successfully participate in the Giveaway, they must meet three conditions: following the KOKOSEK.PL profile on Instagram, liking the giveaway post and tagging at least 3 people under the giveaway post.
2.3 Entries may only be submitted once. Entries cannot be modified. In the event that a single Participant submits two entries, only the Participant's first entry will be considered for evaluation.
2.4 By submitting an entry, the Participant voluntarily consents to participate in the Giveaway and agrees to the application of these Regulations.
2.5 The application must meet the following requirements:
a) it cannot contain vulgarisms, offensive, obscene, pornographic, discriminatory content, content contrary to applicable law or good customs, in particular through content violating freedom of religion or ethnic origin, including content inciting hatred based on race, gender, nationality, sexual orientation, or offending religious feelings;
b) it may not contain advertising content relating to any other entities, with the exception of advertising content relating to the Organizer or the products it offers;
c) it must not damage the image and good name of the Organizer;
d) must be prepared in Polish
2.6 If it is found that the entry does not meet any of the conditions listed above, it will not be assessed and the Participant will be excluded from the Giveaway and will lose the right to the prize provided in the Giveaway.
3. AWARDS
3.1 The prize in The giveaway includes 1 voucher worth PLN 1,000 to be used at KOKOSEK BABY STORE (in-store or online).
3.2 The prize is funded by the Organizer.
3.3 The prize cannot be exchanged for its cash equivalent.
4. DEAL RESOLUTION
4.1 The decision to award the prize rests solely with the Organizer.
4.2 From among the entries that meet the provisions of these Regulations, the Organiser will, at its own discretion, select the entry of the Participant who will consequently be entitled to the Prize.
4.3 The Organizer will inform the Participant about winning the Giveaway via stories on the KOKOSEK.PL profile on the Instagram platform, no later than 7 days after the end of the Giveaway, and will also send him/her a private message.
4.4 The Participant selected in the Giveaway is obliged to send an e-mail to the Organizer at hello@kokosek.pl or a private message on the KOKOSEK.PL profile on Instagram, containing the following information, within 7 days from the date of announcement of the Giveaway results:
a) Name and surname;
b) Residential address in the Republic of Poland;
c) Prize delivery address, if different from the residential address (within the Republic of Poland);
d) Telephone number;
e) Email address.
4.5 Failure to send the message within the time specified in point 4.4 of the Regulations will result in forfeiture of the right to the Prize. In such a case, the Organizer will select another Participant's entry, in accordance with the provisions of the Regulations.
4.6 The Prize will be sent within 30 days from the date of receipt of the correct message referred to in point 4.4 of the Regulations, via a courier company selected by the Organizer / by e-mail, to the address indicated in the message referred to in point 4.4 of the Regulations.
4.7 The Participant loses the right to the Prize if he/she has provided false data in the application or in the message referred to in point 4.4 of the Regulations or if the parcel has been returned to the Organizer due to impossibility of delivery.
4.8 A Participant who refuses to accept the Prize loses the right to it, and the Prize – at the Organizer’s discretion – may be awarded to another Participant.
5. COPYRIGHT
5.1 By sending an entry, the Participant grants the Organizer a free, non-exclusive, territorially unlimited license to the work that is the subject of the entry.
5.2 The license is granted for a period of 5 years from the date of sending the application.
5.3 The license is granted for the following fields of use:
a) in the scope of recording and reproduction – production of copies of the work in any technically possible form and reproduction by any technique in any number of copies, including in particular digital, printing, reprographic and magnetic recording techniques,
b) placing copies of the work on the market, lending or renting them,
c) using all or individual elements of the competition entry for the purpose of creating any advertising materials and using them as part of advertising materials, by recording and reproducing them using the techniques described in point a above, and placing them on the market, renting, lending, and making them publicly available in such a way that everyone can have access to them at a place and time of their choice,
d) entering into computer memory,
e) dissemination and making available on the Internet, on radio or television.
5.4 The Organizer also acquires the right to authorize the exercise of dependent copyrights to the work referred to above, under the terms and conditions set out above for the license.
5.5 By submitting the application, the Participant declares that:
a) is the creator of the work that is the subject of the application and therefore has all copyrights and related rights in this respect, and these rights are not limited in any way or encumbered by the rights of third parties.
b) The work that is the subject of the entry does not infringe the rights of third parties and therefore no third parties will take any action against the Organizers in connection with the Organizer's use of such work.
c) undertakes to indemnify the Organizer against any claims made by third parties in connection with the Organizer's use of the competition entry within the scope specified in the Regulations, resulting from the submission of false declarations by the Participant, and to compensate for any damage resulting therefrom.
6. PERSONAL DATA
6.1 The administrator of the Participants' personal data is the Organizer.
6.2 The personal data of the Participants will be processed by the Organizer for the purposes of conducting the Competition.
6.3 The personal data of the Competition Participants will be stored by the Organizer for the period necessary to conduct the Giveaway and issue the Prize, and will also be stored until the statute of limitations for any claims or the expiry of the obligation to archive data arising from legal provisions.
6.4 Participants have the right to request access to data, rectification, deletion, transfer or restriction of their processing and to raise objections.
6.5 Data is provided on a voluntary basis, but registration on the Instagram platform is required to participate in the Giveaway. Providing data is necessary to fully participate in the Giveaway and to be eligible to receive the Prize.
6.6 In the event of a request to delete data or an objection to the processing of data by the Organizer, the User loses the opportunity to participate in the Giveaway.
7. COMPLAINTS
7.1 Complaints related to participation in the Giveaway may be submitted by the Participant in person at the Organiser’s registered office, the address of which is indicated in §1 of the Regulations, in writing to the following address: KOKOSEK BABY STORE sc, ul. Dyrekcyjna 3, 50-528 Wrocław or electronically via e-mail to the following address: hello@kokosek.pl.
7.2 A complaint should include: the Participant's name and surname, mailing address, a description of the allegations forming the basis for the complaint, and the Participant's expectations. Additionally, complaints submitted in writing must be signed by the Participant.
7.3 Complaints will be considered immediately, but no later than within 14 days from the date of their receipt by the Organizer.
7.4 The Organiser's decision regarding the complaint being considered does not exclude or limit the Participant's rights to pursue their claims under generally applicable provisions of law, including bringing an action before a common court.
8. CLAUSE
8.1 The Giveaway is in no way organized, sponsored, administered or endorsed by Instagram.
8.2 By entering the Giveaway, each Participant agrees to fully release the Instagram platform from any liability that may arise in connection with the Giveaway.
9. FINAL PROVISIONS
9.1 The Organizer is not responsible for the inability to submit an application due to reasons attributable to the Participant.
9.2 Participation in the Giveaway is free of charge.
9.3 Participation in the Giveaway and the rights and obligations related thereto, including the right to request the delivery of a Prize, may not be transferred to other persons.
9.4 Violation of the Rules will result in the Participant being disqualified from the Giveaway. The Organizer will notify the Participant of the disqualification, along with the grounds for disqualification, via email or post.
9.5 The distribution constitutes a public promise within the meaning of Article 921 of the Civil Code.
9.6 The Organizer reserves the right to end the Giveaway early. The Organizer will notify Participants of the planned end of the Giveaway 7 days in advance by posting a message on the KOKOSEK.PL Instagram profile.
9.7 The Organizer will attempt to resolve any disputes amicably, in accordance with the complaints provisions set out above.
9.8 In matters not regulated in the Regulations, the generally applicable provisions of Polish law shall apply.
